Background
On April 10, 2007,
the Rossmoor Community Services District (RCSD) adopted
a Resolution of Application to initiate proceedings
to incorporate the community of Rossmoor. On July 18,
2007, the RCSD officially filed an incorporation application
with the Orange County Local Agency Formation Commission
or LAFCO. LAFCO is the agency within Orange County responsible
for reviewing all city and district boundary changes.

Fair Political Practices Commission Filing Requirements
As with ballot measures generally, individuals and groups are permitted to make expenditures in support of or opposition to the proposed incorporation of Rossmoor. The Political Reform Act (Government Code § 81000 et seq.) contains specific provisions that govern expenditures by “committees”, as that term is defined in Government Code section 82013. Among other things, the Political Reform Act requires committees to disclose expenditures and other information according to specific parameters and schedules. A summary of some of these requirements, provided by the Fair Political Practices Commission (FPPC), can be found on the FPPC website (www.fppc.ca.gov).
It comes as no surprise that there has been both support and opposition to the proposed incorporation of Rossmoor, much of it funded through various groups and individuals. To ensure compliance with the Political Reform Act in deciding whether to incorporate Rossmoor, it is vital that every qualifying “committee” that has made or is planning on making such expenditures in favor of or opposition to the incorporation, does so in accordance with State law.
If you have any questions regarding your status as a “committee” and whether you are subject to the disclosure requirements of the Political Reform Act, you may want to consult the Fair Political Practices Commission (www.fppc.ca.gov) or an attorney regarding the applicability and requirements of the Political Reform Act.
LAFCO Rossmoor Incorporation Public Hearing
On May 22, 2008, Orange County LAFCO held the second public hearing on the proposed incorporation of Rossmoor. The Commission approved the incorporation subject to the implementation of either a 7% or a 9% utility user tax on three utilities: natural gas, water and electricity. For the incorporation to be successful, the incorporation must be approved by a majority of Rossmoor voters on November 4, 2008, and at least one of the two utility user tax measures (7% or 9%) must also be approved by a majority vote. If both utility tax measures pass, the one with the higher number of voter prevails.

Rossmoor
Incorporation Workshop
On March 12th, LAFCO held a public hearing/community
workshop in Rossmoor to present the Draft Comprehensive
Fiscal Analysis and receive public comments on the proposed
incorporation. The workshop took place at the Rush Park
Auditorium and hundreds of residents were in attendance.
